**3. Automatic Bonus:** When I deposited, the bonus was added to my balance automatically. The deposit interface did not provide any option or 'opt-out' toggle to decline the bonus funds. I was forced into the bonus terms at the moment of deposit without being given a choice.

As stated by the operator's customer care, it is your responsibility as the player to read the Terms and Conditions and be aware of the limits on bets and 'Bonus Buy' options. These limits are what you agreed to when you signed up and registered for the bonus, therefore, going over the limit is in fact a breach in the 'contract' between you and the operator.

The limits also apply to _**all**_ transactions/bets, not just the winning ones, so going over the limit during a losing round, is still a breach of the terms.

Based on the information included in the email you never brought up the bonus being placed on your account automatically with the operator. Is there a reason for this?

**1. I DID raise the issue on April 21st:**
I explicitly challenged the automatic bonus and the lack of an "opt-out" option during a **live chat conversation on April 21st**. The reason it is not in the email chain is that it happened in the chat. Boabet actually sent me a link to the chat transcript via email afterward, but **the link does not work because they closed my account**. I am effectively blocked from accessing my own evidence. I kindly request that you ask Boabet to provide the full chat logs from April 21st.

**2. Tone and Stress:**
I must also mention that during that chat, I was extremely stressed and upset about the confiscation of 10,000 NOK. My communication might have been informal or messy because of this shock, but my complaint about being forced into a bonus without consent was clearly stated.

**3. Lack of Safeguards:**
While I acknowledge the player's responsibility, I maintain that allowing "Bonus Buy" transactions of 580 NOK and 1,000 NOK to proceed without a technical block—when the system knows bonus terms are active—is predatory. Allowing the bet and only enforcing the rule after a win feels like a trap.

**4. Proportionality:**
Seizing 10,000 NOK for a subsequent losing round on "Sugar Rush" is a disproportionate penalty that gave me no advantage.

We have discussed this issue with the operator and this is what we found out.

They have confirmed that you did in fact breach the bonus terms and conditions clause 9 which states;


> 9. The maximum single bet permitted whilst using a bonus is €6.25 on slot and video bingo, slingo, skill games and instant games, and €25 on table games and live casino. Exceeding this limit will lead to confiscation of any bonus and associated winning.


When you agree to Terms and Conditions upon registering and signing up to a casino, it then becomes you responsibility to read and understand those terms and ensure you stay within the parameters. Since you admit to buying a bonus at €50, that breaches the above term and the operator is within their rights to void winnings.

The operator is under no obligation to monitor every bet based on the agreed terms and conditions.

Since this is a clear breach of the terms and conditions contract, there is nothing we can assist you further with.

Found for the Casino – BoaBet has provided sufficient evidence to demonstrate that this player has breached terms of use in a non-redeemable fashion.

I am disputing the confiscation of 10,000 NOK from my account. The casino claims I breached the "Max Bet" limit (€6.25) while playing with bonus funds, but I believe the confiscation is unfair and disproportionate for the following reasons:

1. **Forced Bonus:** Upon depositing, the bonus was added automatically without an "opt-out" option. I was forced to play under these restrictive terms without giving my explicit consent.
2. **Inconsistent Grounds for Confiscation:** In their final response, the casino cited a losing transaction on the game "Sugar Rush 1000" (Transaction ID: 23680874868) as the reason for seizure. However, the 10,000 NOK was won on a completely separate game, "Das xBoot". Using a losing round on one game to void unrelated winnings on another is a breach of the principle of proportionality under MGA standards.
3. **Lack of Technical Safeguards:** The casino's system actively allowed me to purchase a "Bonus Buy" for 580 NOK (approx. €50). As the system knows I am using bonus funds, it should have blocked any bet exceeding the limit. Allowing the transaction and only enforcing the rule after a win constitutes "predatory officiating."
4. **Selective Enforcement:** I have previously made successful withdrawals from my account using the exact same playstyle. The fact that the casino approved those withdrawals but now chooses to confiscate this larger win shows that they only enforce these terms when it is financially beneficial for them to do so.

I request that my winnings of 10,000 NOK be reinstated, as the casino has failed to provide a fair, consistent, and transparent gaming environment.

Please note that my account is currently closed. I have previously discussed this matter with their live support on the website, but I no longer have access to those chat transcripts because the casino blocked my access upon closing the account. I request that the mediator asks Boabet to provide the full chat logs and game history for the sessions involving 'Sugar Rush 1000' and 'Das xBoot Zwei'."
