Can you clarify where exactly you feel the misleading advertisement is?

Whilst we appreciate what your saying, the vast majority of online gambling operators, especially in the higher risk/weaker licensed spheres, use 3rd party payment processing companies to manage their payments. These companies levy their own charges for every transaction that is processed and it's possible that these have simply been passed on to players by Instant Casino.

- The operator suggesting getting in touch with my crypto provider to “check about the gas fees” is a diversion manoeuvre. The gas fees of 0.002978859 ETH (~9.81 USD) was paid by me at the time of the transfer as a transaction cost on my end, on top of everything else, which is standard practice, and is not in any way related to the claim in question. This is shown in the provided evidence ‘241220_Transaction_details.pdf’ showing the transaction in the blockchain explorer. The fact that a USDT transfer comes with a gas fee has nothing to do with the misleading USDT/EUR quote presented by the operator. The operator was not, in the quote including an estimate of how much I were to pay in gas fee at some, to them, unknown crypto provider. If that would be the case, the misleading quote would be even more misleading (skewed to my disadvantage). There is no “crypto provider” involved in this transaction other than my non-custodial multiwallet. To reiterate, the operator presented a misleading quote of the USDT/EUR amount that was _received_ into the casino account - not of a guesstimate of what was sent, pre gas fee, from a wallet-type unknown by the operator.
- I believe I have clarified it plenty in my complaint. Instant Casino is responsible for the quote presented to the players on their website. The players do not have a contractual agreement with the payment providers - Instant Casino has. Explicitly stating a false/misleading conversion rate in line with market rate, and only AFTER the transaction is completed, letting players know that it was false/misleading by not crediting the quoted amount to the casino account in full; meaning players' have to infer that they actually lost ~3.5% of their deposit in the conversion,▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇▇

Whilst we understand your frustrations, you've chosen to play with a gambling operator that is unlicensed. If you want to receive the consumer protections in terms of advertising standards that are in line with EU standards, you need to ensure you are playing with an EU licensed operator.

All we can suggest is choosing a different operator to play with in future if you are unhappy with the transaction fees associated with Instant Casinos.

A withdrawal fee is not a transactional issue and does not relate to the fairness of a gambling transaction.

On December 20, 2024, at 12:31 UTC +1, I made a deposit of 1,554.79 EUR into my casino account by transferring a total of 1,670.96 USDT. This transfer was executed precisely following the instructions provided within the banking section of my casino account. At the time the transfer was credited to my casino account, however, there was a significant discrepancy between the EUR/USDT conversion rate applied by the casino and the actual market exchange rate. Specifically, the rate utilized by the casino was approximately 3.4% less favorable than the prevailing market rate.

At the moment I initiated the transfer, the casino's banking section displayed a EUR quotation significantly higher than the amount that was ultimately credited to my account. More concretely, the quoted exchange was nearly equivalent to the actual market conversion rate at that time, resulting in the expectation of receiving approximately 3.5% more EUR compared to the final credited amount. Given that the quoted EUR value closely mirrored the actual market conversion rate at the transfer's time, I did not perceive any reason to doubt or document the exchange calculation specifically during that transaction. Consequently, I did not capture a screen image displaying the quoted conversion at the exact moment of deposit.

However, four days later, on December 24, 2024, I took precaution to document the casino's practice through a screen recording of the banking section. This recording clearly shows that the casino was still quoting an exchange rate nearly identical to the current market rate. Given the consistency demonstrated, it is highly plausible, therefore, that the rate quoted to me on December 20 was also in line with the market's actual exchange rate at that point.

Importantly, fluctuations in the USD/USDT pair remain negligible for these purposes, with the value of USDT constantly hovering very close to USD at a 1:1 ratio. Hence, these differences cannot account for the observed discrepancy.

The casino has responded that the transfer cost disparity stems from fees applied by “my payment provider.” This explanation does not hold validity, as the fee dispute does not involve blockchain transaction fees, which were separate and already covered by me.

I emphasize that I executed the transaction under the explicit premise that the conversion rate would reflect the market rate closely. The significant 3.4% deviation resulted in a loss of approximately 53 EUR. Had I known that I would have to pay this amount in currency conversion fees, I would not have made the transaction. I assert that the casino is accountable for transparently communicating its conversion fees and, at the very least, not portraying them as significantly more favorable than what they truly are. Consequently, I request reimbursement of 53 EUR.
